Introduction
This California Consumer Privacy Act (CCPA) Privacy Notice ("Notice") supplements the information contained in Geocoupler's Privacy Policy and applies solely to residents of the State of California. We have adopted this Notice to comply with the California Consumer Privacy Act of 2018 (CCPA), as amended by the California Privacy Rights Act of 2020 (CPRA), and any implementing regulations thereunder.
Any terms defined in the CCPA have the same meaning when used in this Notice. This Notice does not apply to employment-related personal information collected from California-based employees, job applicants, or contractors.
Personal Information We Collect
We collect information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer, household, or device ("Personal Information").
In the past 12 months, we have collected the following categories of Personal Information: Identifiers (name, email address, IP address, account username); Commercial information (subscription plans, transaction history, billing details); Internet or other electronic network activity (browsing history on our Service, search history, interactions with our platform); Geolocation data (general location based on IP address); Professional or employment-related information (company name, job title); Inferences drawn from the above to create a profile about preferences and behavior.
We obtain these categories of Personal Information directly from you when you register an account or contact us; indirectly from you through your use of the Service; and from third-party partners and analytics providers in connection with your use of our Service.
Use of Personal Information
We may use or disclose the Personal Information we collect for one or more of the following business purposes: to fulfill or meet the reason you provided the information; to provide, support, personalize, and develop our Service; to create, maintain, and secure your account; to process your transactions and send related notices.
Additional uses include: to send you technical notices, updates, security alerts, and support messages; to respond to your comments, questions, and requests; to send promotional communications, where permitted by law; to monitor and analyze trends, usage, and activities in connection with our Service; to detect, investigate, and prevent fraudulent transactions and other illegal activities; and to comply with legal obligations.
We will not collect additional categories of Personal Information or use the Personal Information we collect for materially different, unrelated, or incompatible purposes without providing you with notice.
Sharing Personal Information
We may disclose your Personal Information to our service providers for a business purpose. When we disclose Personal Information for a business purpose, we enter into a contract that describes the purpose and requires the recipient to keep that Personal Information confidential and not use it for any purpose except for performing the contract.
In the preceding 12 months, we have disclosed the following categories of Personal Information for a business purpose: Identifiers; Commercial information; Internet or other electronic network activity information; and Inferences. We have not sold Personal Information in the preceding 12 months, and we do not sell Personal Information as defined under the CCPA.
We may disclose Personal Information to government entities, law enforcement, or other third parties when required by law, subpoena, or other legal process, or when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request.
Your California Privacy Rights
California residents have the following rights under the CCPA/CPRA: The right to know — you may request that we disclose what Personal Information we collect, use, disclose, and sell. The right to delete — you may request that we delete Personal Information we collected about you and direct our service providers to do the same, subject to certain exceptions.
The right to correct — you may request that we correct inaccurate Personal Information that we maintain about you. The right to opt-out of sale or sharing — you have the right to opt out of the sale or sharing of your Personal Information. As noted above, we do not sell Personal Information. The right to limit use of sensitive Personal Information — you have the right to limit our use and disclosure of sensitive Personal Information to purposes necessary to perform the services.
The right to non-discrimination — we will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not deny you goods or services; charge you different prices or rates; provide you with a different level or quality of goods or services; or suggest that you may receive a different price or rate or a different level of quality of goods or services.
Exercising Your Rights
To exercise your rights described above, please submit a verifiable consumer request to us by emailing support@geocoupler.com with the subject line "CCPA Rights Request." Only you or a person registered with the California Secretary of State that you authorize to act on your behalf may make a verifiable consumer request related to your Personal Information.
You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information, or an authorized representative; and describe your request with sufficient detail to allow us to properly understand, evaluate, and respond to it.
We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request. We will only use Personal Information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request. We will respond to a verifiable consumer request within 45 days of receipt. If we require more time (up to an additional 45 days), we will inform you of the reason and the extension period in writing.
Sensitive Personal Information
Under the CPRA, certain categories of Personal Information are classified as "sensitive." Geocoupler does not intentionally collect sensitive Personal Information such as social security numbers, financial account information, precise geolocation, racial or ethnic origin, religious beliefs, health information, or biometric data through the Service.
If you believe that sensitive Personal Information has been inadvertently submitted to or collected by our Service, please contact us immediately at support@geocoupler.com so that we may take appropriate steps to handle such information in accordance with applicable law.
Authorized Agents
You may designate an authorized agent to make a request under the CCPA on your behalf. To do so, you must provide the authorized agent with written permission to submit requests on your behalf, and the agent must verify their identity with us.
We may deny a request from an authorized agent that does not submit proof that they have been authorized by you to act on your behalf. Even when using an authorized agent, we may require you to verify your own identity directly with us in certain circumstances.
Changes to This Notice
We reserve the right to amend this Notice at our discretion and at any time. When we make changes, we will post the updated Notice on our website and update the Notice's effective date. Your continued use of our Service following the posting of changes constitutes your acceptance of such changes.
